 According to 16.4, "It is an error for output escaping to be disabled for a text node that is used for something other than a text node in the result tree. " ... and it doesn't say that this particular error reporting is optional I was wrong ... the Recommendation does, indeed, say that reporting this error is optional so the processor could have just ignored it ... so it looks like Saxon was correct in the way it behaved. .............
