(I'll go and check:-) Although this reminds me to ask, what _were_ you doing with the variable, as a result tree fragment the only thing you can do is xsl:copy-of it into some part of the result, can't you? You can't (unfortunately:-) use a result tree fragment as a source tree for a run with apply-templates, or deconstruct the list in any way.
