So the xsl:variable results in a temporary document--now that I look for it, I see that's explained in 9.4 "Creating implicit document nodes", which I probably never would have read if I hadn't started this discussion (since I would only every want to create document nodes *explicitly* why would I care about creating them implicitly?) :-) Now I get it (I think). And thanks to both Andrew and Mike for pointing out the XPath alternative--I still have a bit of XSLT/XPath 1 brain damage and I forget that XPath 2 is much more capable than before.
