In particular you can't put it in xsl:variable If you do you get an _XML_ parse error and XSLT won't even start. XSLT never manipulates tags so it never makes sense to process a start tag and not the end tag. Think in terms of a node tree not of the markup used to express that tree in a linear document: you can't have half a node.
