List-block choose trouble with duplicates

My scenario is this
If there is a title in step2 number it like:
2.1	This is my title

	This is my paragraph
	
If there is no title, number the paragraph like:

2.1	This is my paragraph

If there is a warning|caution|note before paragraph still number the
paragraph like:
	Warning
	Caution
	Note
2.1	This is my paragraph.

My test for title works fine but then I'm confused.
In my test for warning|caution|note if I apply-templates at the end I
get:

	Warning
	Caution
	Note
2.1	This is my paragraph.
	Warning
	Caution
	Note
	This is my paragraph. 

Here's what I have right now, but there must be a better way to do this:
