this is specified as a recoverable error, the system is allowed to
report it (and die) or just silently ignore the offending instruction.

You can't add attributes after you have added child nodes so

<foo>
<x/>
<xsl:attribute name="y">
is bad, as is

<foo>
hello
<xsl:attribute name="y">

You have to have

<foo>
<xsl:attribute name="y">
