& is just an & as character data and can be used anywhere character
data is allowed, if it is failing on your system it sounds like a bug.
Are you sure that & is really being entered in the file, not being
masked by some buggy "xml aware" inut system.

Where exactly is the problem, the fO file is not generated or the FO is
generated but your FO system does not render it?
