Any software that requires that is definitely broken and you should report a bug to them. The XML spec is quite clear that utf8 is default in this case so there is no need for an XML declaration. You can always run your file through sed -e "s/encoding=\"utf8\"//" file.xml to remove the string after you've done the transform.
