  gives me an error, saying that variables and 
  parameters cannot be used in patterns.

variable can't be used in patterns. Check you have tehlatest xalan 9and
report a bug if not)

The subjectline is misleading though, variablea are allowed in Xpath
expressions in all contexts except patterns.
