Number error with XALAN

Hi there,

i have following problem
in my XSL there is a section containing the following code, which ran
without producing errors with XT
but produces a "Can not convert #NUMBER to a NodeList!" error with XALAN.

What can i do? our new environment forces me to use XALAN

Output is a simple
1) entry
2) entry 2...
..
list.

I believe it's not an fo problem, so i posted it here...
