Here is your problem, $pos is bound to /doc/sections *nodeset*, but you need it to be a number in order to filter by position number. So either convert it to number expicitly or explicitly compare with position(): select="$sections/section[@group=1]/item[@id=1][number($pos)]" select="$sections/section[@group=1]/item[@id=1][position()=$pos]"
