This is best accomplished by using two passes: first sort, then de-duplicate on the sorted order. The two passes can be combined in a single stylesheet if you're willing to use a node-set() extension function to turn a result tree fragment (the sorted node set bound to a variable, say) into a true node set (so it can be traversed). In XSLT 2.0 the need for the extension function will go away. In general, since XSLT processing is declarative, functional and side-effect-free, you don't have access to information about what's processed when. In fact, strictly speaking you shouldn't -- XSLT specifies how the output should be arranged, but doesn't specify in what order the processor does anything.
