xpath select
Use:

<xsl:variable name="xpath" 
    select="//Header[$Path]/*[name()=$Path] 
          |
            //Header[not($Path)]"/>

Because the conditions in the two predicates negate each other, only
one of the operands of the above union will actually be selected.
