Depending on the exact details of your source document, you might be able to
do this with

<xsl:template match="section/text()">
  <p><xsl:copy-of select="."/></p>
</xsl:template>

<xsl:template match="section/p[not(node())]"/>

<xsl:template match="p">
<xsl:copy-of select="."/>
</xsl:template>
