Have you tried to create the attribute nodes as contents of a variable?
<xsl:variable name="attset">
<xsl:choose>
<xsl:when test="RenderX">
<xsl:attribute ... > ... </>
<xsl:attribute ... > ... </>
</xsl:when>
<xsl:otherwise>
<xsl:attribute ... > ... </>
...
</xsl:otherwise>
</xsl:choose>
</xsl:variable>
and then
<fo:the-desired-element>
<xsl:copy-of select="$attset" />
...
</>
(not tested)
