yes but if (as in SQL, or a three valued logic system) you have a null
value, then you are at least free, when  defining the system to specify
soome set of rules for null that make sense.

But Xpath tries to model null by (). Since almost all occurrences of ()
don't come from any nul markup in the source (eg xsi:nil) but rather
just being the empty result of some query, this is bound to lead to
problems.
