If you're using saxon you can set this on the xsl:document element.
Other processors have similar elements frr this. I believe most of them support setting the output charset enc.
Check out your process. documentation for details.

I understand the encoding attribute of the xsl:output needs a string as an
input and not an expression... so can I still do it? or do I need a
different xsl stylesheet...
