It doesn't really test if the first node is text, it just tests that it
is not an element: in particular it is true if the first node is a
comment, or if the element is empty.
You don't need name() anyway elements always have a name so if *[1]
returns anything at all then that will be true as a boolean, and name()
is therefore also true, so the above is the same as
not(*[1])
but what yiy said you wanted was
node()[1][self::text()]
