your problem isn't with not() it is with []

self::para

selects the current node if it is a para, and selects the empty set
otherwise.

so...

self::para[1]

selects the first node in th eabove, ie it is the same as 

self::para

you want somnething like

 <xsl:apply-templates select="*[
  not(self::para and not(preceding-sibling::para))
   and not(self::title) and 
   not(self::graphic and not(preceding-sibling::graphic))]" />
