 Comment nodes can have only text-node children.
To accomplish what you wanted (I know this is ugly...) use:
<xsl:value-of select="'<!-- '" disable-output-escaping="yes"/>
<xsl:copy-of select="/page/foo"/>
<xsl:value-of select="' -->'" disable-output-escaping="yes"/>
