Well,

it's not well-formed, so it doesn't even get to the XSLT engine.

Use:

<xsl:variable name="reports"
select="document('http://localhost:591/FMPro?-DB=Reports.FP5&amp;-format=-ds
o_xml&amp;Client=WMC&amp;-Find')"/>
