<xsl:stylesheet version="1.0"
                xmlns:xsl="http://www.w3.org/1999/XSL/Transform">

<xsl:template match="/">
  <xsl:apply-templates select="node()" />
</xsl:template>

<xsl:template match="@*|node()">
  <xsl:copy>
    <xsl:apply-templates select="@*|node()"/>
  </xsl:copy>
</xsl:template>

<xsl:template match="code">
  <xsl:apply-templates select="@*|node()"/>
</xsl:template>

</xsl:stylesheet>

Will just remove the code element and copy it's content. If you want to
remove code element and it's content, use

<xsl:template match="code" />

instead. Note that the stylesheet will not preserve the doctype declaration
and encoding, so the output will not be identical except for the code
element missing.
