No, Saxon 6.2.2.

XT does give the error "cannot convert to node-set"

Xalan gives XSLT Error (javax.xml.transform.TransformerException): Can not
convert #RTREEFRAG to a NodeList!

So perhaps it's a quirk (bug? feature?) of Saxon that it is more lenient?
And I should be using the node-set extension functions?
