node set into a variable to save using the long xpath twice.
<xsl:variable name="foo"
select="document('../../released_xml/news_xml_en/newsticker.xml')/News/Block
[@STARTDATE = '01']"/>
<xsl:for-each select="$foo">
...
</xsl:for-each)
<xsl:choose>
<xsl:when test="not($foo)">
<!-- or if you prefer, count($foo) = 0 ,
which is the same thing -->
...
