In Saxon 5.5 I relaxed the restrictions on use of result tree fragments, (a)
to anticipate the published requirements for XSLT 1.1, and (b) to emulate
the behavior of the MSXML3 beta product. This was a regrettable departure
from my usual policy of strict conformance, especially as Microsoft withdraw
the feature in their final release. I have reverted to the previous
situation in Saxon 6.0, where you need to use the saxon:node-set() extension
function.
