It's an error for the document function to reference a file that doesn't exist; the processor is allowed to (but not required to) recover from the error by returning an empty node-set. With Saxon 5.5, you can control whether Saxon reports such errors and stops, reports them and continues, or recovers silently: but if you rely on this, your stylesheet won't be portable.
