Easiest is to change the match expresion

<xsl:template match="TABLE/TR[1]|
                     TABLE/*[not(self::TLT)][1]/*[1][self::TR]">
 this
</xsl:template>

<xsl:template match="TR">
 else this
</xsl:template>
