Ah - that's *not* an attribute.  Yes, it looks like one, but it's not -
it's a namespace declaration.  That's what the section you quoted from
§7.1.3 of XSLT means.

The namespace declaration is an integral part of an element; you can't
<xsl:copy> it and then alter the namespace declaration.  You need to create
a new and different element with its own namespace - that's the whole point
of namespaces, that <oldxsl:stylesheet> and <xsl:stylesheet> are completely
different things despite the similarity of their names.  You need to match
old XSL elements and create new ones.  (BTW, the URI you're using for the
result is out of date; take a look at the Proposed Recommendation at
<URL:http://www.w3.org/TR/xslt>.)
