If the above is all you need to do with the resulting node list, you could achieve the same result with a very different approach:


  <xsl:choose>
     <xsl:when test="/RESPONSE/FILTERED">
        <xsl:for-each select=".....whatever....">
           <xsl:call-template name="common"/>
        </xsl:for-each>
     </xsl:when>
     <xsl:otherwise>
        <xsl:for-each select="/RESPONSE/PRODUCT">
           <xsl:call-template name="common"/>
        </xsl:for-each>
     </xsl:otherwise>
  </xsl:choose>
</xsl:template>

<xsl:template name="common">
  <!--process product here-->
</xsl:template>

If you have no other need for the variable, then you don't need to try to set it.
