The "damage" isn't done during serialisation, it is done during node
construction, which allows multiple elements as children of a document node.

when the xslt spec wants to say (more or less) that if you parse the
result of serialisation you get back something equivalent, it defines
this in terms of making an element node reference the external general
parsed entity, and then stripping off the element node before comparison

http://www.w3.org/TR/xslt#section-XML-Output-Method

...
In addition, the output should be such that if a new tree was
constructed by parsing the wrapper as an XML document as specified in [3
Data Model], and then removing the document element, making its children
instead be children of the root node, then the new tree would be the
same as the result tree, with the following possible exceptions:

...

so you could just serialise document nodesas <x:document>....</x:document>
and reconstruct the XDM by taking the content of teh x;document element
(discarding the namespace bound to x) and making that the content of a
document node. this is a little more than just an xml parser, but
trivial bit of xquery for example.
