Personally, I believe that those of us who rely on XML every day should be doing whatever we can to get the law or practice changed to stop the sort of silliness that is allowing people to chip away at the scope of applications for which we can use XML. Any claim that says something like "Doing x with XML." should be rejected. If "Doing x." isn't good enough to be a claim or if "Doing x with a generic encoding format." isn't good enough, then the claim should fail. The idea of claiming a patent on something because you do it with XML or HTML instead of doing it with ASN.1, XDR, CSV, etc. is ridiculous. Yes, I've raised this issue before... Numerous times.
