Unfortunately I live in Washington state, not NY, and the government 
here tends not to question what Microsoft wants. :-) I'm hoping that 
this sort of license agreement will be ruled illegal everywhere. I'm 
also hoping that the DMCA will self-destruct. I'm not holding my breath 
waiting for either event to happen, though.

You'd think the marketplace would itself discourage vendors (at least 
the non-monopoly ones) from distributing software with these types of 
agreements. Doesn't seem to work that way, though.
