That is correct but I the W3C text isn't very explicit.  

There are copyrighted DTDs that use many of the 
same elements and attributes as are in HTML and 
predate it.  <p>, <a>, <table>, <body> etc aren't 
exactly novel stuff.  So even parts of the text 
and DTDs aren't that defensible.

Hmm?  Should we be writing and copyrighting 
schema as fast as we can in any domain we 
can?  Seems a lot more lucrative than squatting 
on domain names.

I should have qualified this as derivation of technique, not derivation
of the text as a whole.
