Certainly, the BNF is ambiguous, but the subsequent precedence rules take care of most of that. Also, in the Use Case document, some of the 'Solutions in XQuery' appear to assume a different set of precedence rules, but it's not clear whether the Solutions or the grammar is at fault. -Michael Dyck
