Modules can use DOM without being bundled into > DOM itself. XPath can (and IMHO should) be such a layer. The DOM WG has done its best to design the DOM to be usable as the basis for such layering. And, for example, MathML, SMIL and SVG are all doing DOM modules fo ruse on top of the basic DOM. XPath would be a module no matter who did it; the only question is who should do it.
