In section 3.2.1 it says "for compatibility, it is an error..." and
points at Appendix E, "Non-Deterministic Content Models (Non-Normative)"
for details.  Seems to me that 3.2.1 is normative.

However, in translation, that means that processors may do pretty much
whatever they like there ... but documents mustn't depend on such DTD
constructs ever working, or even being detected by an XML processor.
