So non-validating processors don't have to detect the error. (Of course a n-v parser that doesn't read the external subset can't detect errors in it - that's why it isn't a WF constraint - but there are n-v parsers that do read it.) My parser (RXP / LT-XML) relies on the fact that since PEs have spaces inserted around them, they can only start and finish in places where whitespace would be legal.
