I have the follwing xQuery and it can have up to 16 lines of notes for each line. Is it possible to not show the empty tag if the tag is empty.

My output is showing a
<Note/> for every blank note line.

Could this be removed with coding?

You can do it with code similar to this:
{if ($component/contact) then
<Note>
{
$component/contact/text()
}
</Note>
else ()
}

That worked great, the only thing a can't get loaded is that I need the output in <Process Purchase Order> the be the following.

<ProcessPurchaseOrder xmlns="http://www.openapplications.org/oagis/9" releaseID="1.0">

When I change it to the above my data goes away.
